We call habeas corpus the Great Writ of Liberty. But it was actually a writ of power. In a work based on an unprecedented study of thousands of cases across more than five hundred years, Paul Halliday provides a sweeping revisionist account of the world’s most revered legal device.
In the decades around 1600, English judges used ideas about royal power to empower themselves to protect the king’s subjects. The key was not the prisoner’s “right” to “liberty”—these are modern idioms—but the possible wrongs committed by a jailer or anyone who ordered a prisoner detained. This focus on wrongs gave the writ the force necessary to protect ideas about rights as they developed outside of law. This judicial power carried the writ across the world, from Quebec to Bengal. Paradoxically, the representative impulse, most often expressed through legislative action, did more to undermine the writ than anything else. And the need to control imperial subjects would increasingly constrain judges. The imperial experience is thus crucial for making sense of the broader sweep of the writ’s history and of English law.
Halliday’s work informed the 2008 U.S. Supreme Court ruling in Boumediene v. Bush on prisoners in the Guantánamo detention camps. His eagerly anticipated book is certain to be acclaimed the definitive history of habeas corpus.
These days, the idea of the cyborg is less the stuff of science fiction and more a reality, as we are all, in one way or another, constantly connected, extended, wired, and dispersed in and through technology. A new model of health emerged in Britain between 1870 and 1939. Centered on the working body, organized around the concept of efficiency, and grounded in scientific understandings of human labor, scientists, politicians, and capitalists of the era believed that national economic productivity could be maximized by transforming the body of the worker into a machine. At the core of this approach was the conviction that worker productivity was intimately connected to worker health.
Under this new “science of work,” fatigue was seen as the ultimate pathology of the working-class body, reducing workers’ capacity to perform continued physical or mental labor. As Steffan Blayney shows, the equation between health and efficiency did not go unchallenged. While biomedical and psychological experts sought to render the body measurable, governable, and intelligible, ordinary men and women found ways to resist the logics of productivity and efficiency imposed on them, and to articulate alternative perspectives on work, health, and the body.
Health obsessed the Victorians. The quest for health guided Victorian living habits, shaped educational goals, and sanctioned a mania for athletic sports. As both metaphor and ideal, it influenced psychology, religion, moral philosophy; it affected the writing of history as well as the criticism of literature. Here is a wide-ranging and ably written exploration of this fascinating aspect of Victorian ideas.
Bruce Haley looks at developments in personal and public health, and at theories about the relation between medical and psychological disorders. He examines influential conceptions of the healthy man: Carlyle's healthy hero, Spencer's biologically perfect man, Newman's gentleman-Christian, Kingsley's muscular Christian. He describes the development of sports and physical training in nineteenth-century England and their importance in schools and universities. He traces the concept of healthy body and healthy mind in boy's fiction (such as Torn Brown's School Days), self-help literature, and the widely read novels of George Eliot, Wilkie Collins, George Meredith, and Charles Kingsley. The prevailing assumption regarding the Victorians’ relationship to ancient Greece is that Greek knowledge constituted an exclusive discourse within elite male domains. Heretical Hellenism: Women Writers, Ancient Greece, and the Victorian Popular Imagination challenges that theory and argues that while the information women received from popular sources was fragmentary and often fostered intellectual insecurities, it was precisely the ineffability of the Greek world refracted through popular sources and reconceived through new fields of study that appealed to women writers’ imaginations.

Punctuated with remarkable case studies, this book explores extraordinary encounters between hermaphrodites--people born with "ambiguous" sexual anatomy--and the medical and scientific professionals who grappled with them. Alice Dreger focuses on events in France and Britain in the late nineteenth century, a moment of great tension for questions of sex roles. While feminists, homosexuals, and anthropological explorers openly questioned the natures and purposes of the two sexes, anatomical hermaphrodites suggested a deeper question: just how many human sexes are there? Ultimately hermaphrodites led doctors and scientists to another surprisingly difficult question: what is sex, really?
Hermaphrodites and the Medical Invention of Sex takes us inside the doctors' chambers to see how and why medical and scientific men constructed sex, gender, and sexuality as they did, and especially how the material conformation of hermaphroditic bodies--when combined with social exigencies--forced peculiar constructions. This leads to an epilogue, where the author discusses and questions the protocols employed today in the treatment of intersexuals (people born hermaphroditic). Tracing the Victorian crisis over the representation of working-class women to the 1842 Parliamentary bluebook on mines, with its controversial images of women at work, Hidden Hands argues that the female industrial worker became even more dangerous to represent than the prostitute or the male radical because she exposed crucial contradictions between the class and gender ideologies of the period and its economic realities.
Drawing on the recent work of feminist historians, Patricia Johnson lays the groundwork for a reinterpretation of Victorian social-problem fiction that highlights its treatment of issues that particularly affected working-class women: sexual harassment; the interconnections between domestic ideology and domestic violence; their relationships to male-dominated working-class movements such as Luddism, Chartism, and unionism; and their troubled connection to middle-class feminism.

Geoffrey of Monmouth’s History of the Kings of Britain—the earliest work to detail the legendary foundation of Britain by Brutus the Trojan and the life of King Arthur—was among the most widely read books throughout the Middle Ages. Its sweeping account of the Britons began long before the Romans and challenged the leading histories of the twelfth century. Merlin, Guinevere, Mordred, Yvain, Gawain, and other popular Arthurian figures first come to life in Geoffrey’s chronicle. It was the ultimate source of tales retold in Malory’s Morte d’Arthur, Shakespeare’s Cymbeline and King Lear, and Tennyson’s Idylls of the King.
The History survives in hundreds of manuscripts in Geoffrey’s standard text. This volume presents the first English translation of what may have been his source, the anonymous First Variant Version. This shorter and less polished Latin version of the History is attested in just a handful of manuscripts. It belonged to and was probably written by Archdeacon Walter of Oxford, who died in 1151.
In Home Economics: Domestic Fraud in Victorian England, Rebecca Stern establishes fraud as a basic component of the Victorian popular imagination, key to its intimate, as well as corporate, systems of exchange. Although Victorian England is famous for revering the domestic realm as a sphere separate from the market and its concerns, actual households were hardly isolated havens of fiscal safety and innocence. Rather, the Victorian home was inevitably a marketplace, a site of purchase, exchange, and employment in which men and women hired or worked as servants, contracted marriages, managed children, and obtained furniture, clothing, food, and labor. Alongside the multiplication of joint-stock corporations and the rise of a credit-based economy, which dramatically increased fraud in the Victorian money market, the threat of swindling affected both actual household commerce and popular conceptions of ostensibly private, more emotive forms of exchange. Working with diverse primary material, including literature, legal cases, newspaper columns, illustrations, ballads, and pamphlets, Stern argues that the climate of fraud permeated Victorian popular ideologies about social transactions. Beyond providing a history of cases and categories of domestic deceit, Home Economics illustrates the diverse means by which Victorian culture engaged with, refuted, celebrated, represented, and consumed swindling in familial and other household relationships.
A seventeenth-century English traveler to the Eastern Mediterranean would have faced a problem in writing about this unfamiliar place: how to describe its inhabitants in a way his countrymen would understand? In an age when a European education meant mastering the Classical literature of Greece and Rome, he would naturally turn to touchstones like the Iliad to explain the exotic customs of Ottoman lands. Few battles in world history provide a cleaner dividing line than Waterloo: before, there was Napoleon; after, there was the Pax Britannica. While Waterloo marked France’s defeat and Britain’s ascendance as an imperial power, the war was far from over for many soldiers and sailors, who were forced to contend with the lasting effects of battlefield trauma, the realities of an impossibly tight labor market, and growing social unrest. In 1958, ad man and soon-to-be best-selling author Shepherd Mead moved to England with his family to pursue his career. Six years later, his observations on the oddities of British culture were enough to compile a satirical guidebook for fellow Americans planning to visit from across the pond. The blunders that could befall them were many. For instance, explains Mead, “Pants are always underpants and what you wear out in the open are trousers. In following this narrative, we discover that our usual ways of looking at history--through the lens of nationalism or globalization--are not adequate. The national ideal did not simply give way to inevitable globalization in the late twentieth century, as is often supposed; Bose reveals instead the vital importance of an intermediate historical space, where interregional geographic entities like the Indian Ocean rim foster nationalist identities and goals yet simultaneously facilitate interaction among communities.

Hunger is as old as history itself. Indeed, it appears to be a timeless and inescapable biological condition. And yet perceptions of hunger and of the hungry have changed over time and differed from place to place. Hunger has a history, which can now be told.
At the beginning of the nineteenth century, hunger was viewed as an unavoidable natural phenomenon or as the fault of its lazy and morally flawed victims. By the middle of the twentieth century, a new understanding of hunger had taken root. Across the British Empire and beyond, humanitarian groups, political activists, social reformers, and nutritional scientists established that the hungry were innocent victims of political and economic forces outside their control. Hunger was now seen as a global social problem requiring government intervention in the form of welfare to aid the hungry at home and abroad. James Vernon captures this momentous shift as it occurred in imperial Britain over the past two centuries.
Rigorously researched, Hunger: A Modern History draws together social, cultural, and political history in a novel way, to show us how we came to have a moral, political, and social responsibility toward the hungry. Vernon forcefully reminds us how many perished from hunger in the empire and reveals how their history was intricately connected with the precarious achievements of the welfare state in Britain, as well as with the development of international institutions, such as the United Nations, committed to the conquest of world hunger. All those moved by the plight of the hungry will want to read this compelling book.
Hsueh traces the historical development and theoretical implications of proprietary constitutionalism by examining the founding of the colonies of Maryland, Carolina, and Pennsylvania. She provides close readings of colonial proclamations, executive orders, and assembly statutes, as well as the charter granting Cecilius Calvert the colony of Maryland in 1632; the Fundamental Constitutions of Carolina, adopted in 1669; and the treaties brokered by William Penn and various Lenni Lenape and Susquehannock tribes during the 1680s and 1690s. These founding documents were shaped by ambition, contingency, and limited resources; they reflected an ambiguous and unwieldy colonialism rather than a purposeful, uniform march to modernity. Hsueh concludes by reflecting on hybridity as a rubric for analyzing the historical origins of colonialism and reconsidering contemporary indigenous claims in former settler colonies such as Australia, New Zealand, and the United States.
